Nygma Copyright and DMCA Policy

This policy explains how Genie9 LTD (“Genie9”, “we”, “us” or “our”), a company registered in England and Wales with company number 08669198, handles complaints that content on Nygma — its drives, share links and Nygma Chat (the “Service”) — infringes copyright.
We handle notices under the law that applies to them, including the notice-and-takedown process of the US Digital Millennium Copyright Act (“DMCA”, 17 U.S.C. § 512) and UK law. This policy is part of our Terms of Service.
1. Our Approach
1.1 Our Rules
- • You must not use Nygma to store, share or send content that infringes copyright or other intellectual property rights (see our Acceptable Use Policy).
- • You alone are responsible for making sure you have the right to store and share your content.
1.2 We Act on What We Can Reach
- • Files, file names and chats are encrypted on the user’s device. We cannot see, search or scan them, and we cannot open the content behind a password-protected share link.
- • We cannot remove content from someone’s private drive or chats, or from copies on their devices.
- • We can act on the things we control: we can disable share links, and we can restrict, suspend or close accounts.
2. Sending a Copyright Notice
2.1 Where to Send It
- • Email: legal@genie9.com, with “Copyright notice” in the subject line

2.2 What Your Notice Must Include
- 1.A physical or electronic signature of the copyright owner or of a person authorised to act for them
- 2.Identification of the copyrighted work you say is infringed — or, if one notice covers several works, a representative list
- 3.Identification of the infringing material and enough information for us to find it — for Nygma, the full share link (URL) and, if you know it, the email address of the account. We cannot find content by its file name or description, because names are encrypted.
- 4.Your contact details: name, postal address, telephone number and email address
- 5.A statement that you believe in good faith that the use of the material is not authorised by the copyright owner, its agent or the law
- 6.A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act for them
2.3 Before You Send
- • We may ignore a notice that is incomplete, or ask you for more information.
- • Consider whether the use may be allowed by law — for example fair use in the US, or fair dealing and other exceptions in the UK.
- • Under US law (17 U.S.C. § 512(f)), anyone who knowingly and materially misrepresents that material is infringing may be liable for damages.
- • We may send a copy of your notice, including your name and contact details, to the user concerned.
3. What We Do With a Notice
When we receive a notice that meets the requirements above, we act expeditiously, as the law requires. We may:
- • Disable the share link or links concerned
- • Restrict sharing from the account, or suspend or close the account
- • Tell the user and send them a copy of the notice
We cannot check the content behind a share link, so we may act on a notice without being able to see the material. We decide what action is appropriate, and we may decline to act on a notice we believe is invalid or abusive.
4. Counter-Notice
4.1 Sending a Counter-Notice
If you believe your share link was disabled because of a mistake or misidentification, you may send a counter-notice to legal@genie9.com that includes:
- 1.Your physical or electronic signature
- 2.Identification of the material that was disabled and where it appeared before (the share link)
- 3.A statement under penalty of perjury that you believe in good faith that the material was disabled as a result of mistake or misidentification
- 4.Your name, postal address and telephone number
- 5.A statement that you consent to the jurisdiction of the US Federal District Court for the judicial district where your address is — or, if your address is outside the United States, any judicial district in which Genie9 may be found — and that you will accept service of process from the person who sent the original notice or their agent
4.2 What Happens Next
- • We send a copy of your counter-notice to the person who sent the original notice.
- • Where US law applies, we may re-enable the material between 10 and 14 business days after we receive the counter-notice, unless the complainant tells us first that they have started court action.
- • We do not have to re-enable a share link if your account has been restricted or closed for another reason.
5. Repeat Infringers
- • We close, in appropriate circumstances, the accounts of users who repeatedly infringe copyright.
- • We decide who is a repeat infringer. We keep records of the notices we receive for each account, and we may close an account after a single notice if the infringement is serious.
- • Accounts closed for infringement are closed without a refund, to the extent the law allows, and we may refuse new accounts from the same person.
6. Other Laws and Other Rights
- • Notices under UK, EU or other non-US law should contain the same information as in section 2.2 (the statement under penalty of perjury applies only under US law). We handle them under the law that applies.
- • Complaints about trade marks or other intellectual property rights go to legal@genie9.com.
- • Reports of other illegal or harmful content go to abuse@genie9.com.
7. Limitations
- • We do not monitor or scan content, and the law does not require us to.
- • We are not a party to disputes between rights holders and our users, and we do not decide who owns a work.
- • We do not promise any particular response time, other than acting as the law requires.
- • Nothing on this page is legal advice.
