Terms of Service — Nygma
Last Updated: October 13, 2026
1. About These Terms
1.1 Who we are
Nygma is provided by Genie9 LTD, a company registered in England and Wales ("Genie9", "we", "us", "our"). These Terms of Service ("Terms") govern your use of Nygma on the web (nygma.genie9.com), on Android and on iOS, including Nygma Chat (together, the "Service").
1.2 Your agreement
By creating an account, signing in or using the Service you agree to these Terms. If you do not agree, do not use the Service.
These documents form part of these Terms:
- • Privacy Policy
- • Acceptable Use Policy
- • Refund & Cancellation Policy
- • End User License Agreement (for the mobile apps)
- • Child Safety Standards
If you get Nygma from Google Play or the Apple App Store, that store's terms also apply to your download and to purchases made through it.
2. Who Can Use Nygma
2.1 Minimum age
You must be at least 16 years old to use Nygma, including Nygma Chat. By using the Service you confirm that you are.
2.2 Eligibility
You may not use the Service if you are barred from doing so under the laws of the United Kingdom, the country you live in, or any sanctions or export rules that apply to you. Each account is for one person. If you use Nygma on behalf of an organisation, you confirm you are authorised to accept these Terms for it.
3. Your Account and Sign-In
3.1 Passwordless sign-in
Nygma accounts have no account password. You sign in with a one-time code we email to you, or with Sign in with Google or Sign in with Apple where offered. Anyone who can read your email or control your Google or Apple account can sign in to your Nygma account, so keep them secure. You may turn on two-factor authentication on the web.
3.2 Your responsibility
You are responsible for everything done through your account and for keeping your email address up to date. Tell us at support@genie9.com if you believe your account has been misused. Signing out ends your session on every device.
3.3 Accurate details
The name and email address you give us must be yours. We may refuse to open an account, or close one, at our discretion, including where we restrict sign-ups from certain countries.
4. Encryption and Your Keys
4.1 Zero-knowledge design
Your files, file and folder names, thumbnails and file details are encrypted on your device before they reach us. Each drive is protected by a drive password you choose, which never leaves your device. We cannot read your encrypted data, and we cannot decrypt it for you or anyone else. See the Zero-Knowledge Statement.
4.2 We cannot recover your passwords
You alone are responsible for your drive passwords, PINs, drive recovery phrases and your chat recovery phrase. We cannot reset or recover them. If you lose a drive password and its recovery phrase, the data in that drive is permanently lost. We are not responsible for any loss that results.
4.3 What we can see
Some information is not end-to-end encrypted because the Service needs it: your name and email, the names you give your drives, file sizes, counts and dates, your plan and billing records, and technical data such as IP addresses. The Privacy Policy explains this in full.
4.4 Duress mode and Time Bomb
Duress mode lets a duress password open a decoy drive. Time Bomb, if you switch it on, permanently deletes all of your drives and files after a period of inactivity that you choose, with or without warning emails. Both work exactly as you configure them; data wiped or hidden by these features cannot be restored, and we are not liable for the consequences of using them.
5. The Service
5.1 What Nygma provides
- • Encrypted drives for files, photos and videos, with optional PINs, recovery phrases and App Lock
- • Password-protected share links with optional expiry
- • Duress mode and Time Bomb (on the plans that include them)
- • Nygma Chat — end-to-end encrypted messaging between people who invite each other (mobile apps)
- • Access on the web, Android and iOS
5.2 Changes to the Service
We may add, change, limit, suspend or withdraw any feature, plan, storage limit or app version at any time, including features of the free plan. Where a change takes away a significant part of a paid plan you have already paid for, you may cancel and the Refund & Cancellation Policy applies. Features marked beta or preview are provided as they are and may change or disappear.
5.3 Keep your own copies
Nygma is not a guaranteed backup. Keep your own copies of anything you cannot afford to lose.
6. Plans, Payment and Renewal
6.1 Free and paid plans
Nygma has a free plan and paid subscriptions, billed monthly or yearly. The price, storage and features of each plan are shown in the app or at checkout when you buy. Prices include or exclude taxes as shown at checkout.
6.2 Where you pay
Subscriptions bought through Google Play or the Apple App Store are billed, renewed, managed and refunded by Google or Apple under their terms; we cannot change or refund them. Subscriptions bought on our website are billed by our payment processor, Stripe. A subscription belongs to the store it was bought through; the app will not sell you a second subscription through another store.
6.3 Automatic renewal
Subscriptions renew automatically at the end of each period at the then-current price until you cancel. You authorise the store or Stripe to charge you on each renewal.
6.4 Price changes
We may change our prices. Store subscribers are told by Google or Apple under their rules. Website subscribers are told by email at least 14 days before a new price applies to their next renewal; if you do not want to pay it, cancel before that renewal.
6.5 Failed payments
If a payment fails or is reversed, we may move your account to the free plan or suspend it until the amount is paid.
7. Cancellation, Refunds and Downgrades
7.1 Cancelling
You can cancel at any time — in Google Play or the App Store for store subscriptions, or in your account for website subscriptions. Cancellation takes effect at the end of the period you have paid for; you keep your paid plan until then.
7.2 No refunds except where required
Payments are non-refundable, and we do not give refunds or credits for partial periods, unused storage, downtime or features you did not use, except where the law requires it or the store that billed you grants one. Full details: Refund & Cancellation Policy.
If you are a consumer in the UK or EU and buy on our website, you ask us to start your subscription immediately when you buy it, and you acknowledge that you lose your right to cancel within 14 days once the service has been fully provided; if you cancel within 14 days before then, we may deduct an amount for the service already provided, as the law allows.
7.3 After a paid plan ends
Your account returns to the free plan. While your data exceeds the free plan's limits you cannot upload, and we may delete data above those limits after giving you at least 30 days' notice by email.
8. Your Content
8.1 It stays yours
You keep all rights in what you store, share or send with Nygma ("Your Content"). You give us the permission we need to store, copy and transmit Your Content, in encrypted form, to provide the Service.
8.2 You are responsible for it
You are solely responsible for Your Content and for having the right to store and share it. You must not use Nygma for anything our Acceptable Use Policy forbids.
9. Share Links
9.1 You control access
Anyone who has a share link and its password can open what it shares until the link expires or you remove it. Choose who receives links and passwords carefully; we are not responsible for what recipients do with what you share.
9.2 Links we may disable
We may disable any share link, without notice, if we reasonably believe it is used to break these Terms or the law.
10. Nygma Chat
10.1 What Nygma Chat is
Nygma Chat lets you exchange messages, photos, videos, files, voice messages and locations with people who accept your invitation (a QR code or a one-time link). Chats are end-to-end encrypted: we cannot read them, we do not scan them, and we cannot recover them if you lose your phone and your chat recovery phrase. There is no directory, search or random matching. By setting up Chats you agree to this section and to the chat rules below, in addition to the rest of these Terms.
10.2 Who can use it
You must be at least 16 to use Nygma Chat. Only people whose invitation you accept, or who accept yours, can message you.
10.3 Chat rules
You must not use Nygma Chat to send, share or ask for:
- • Child sexual abuse material, anything that sexualises children, or contact with a child for sexual purposes — zero tolerance; see our Child Safety Standards
- • Messages or content that threaten, harass, bully, stalk or intimidate anyone, or encourage self-harm
- • Intimate images of anyone without their consent, or threats to share them
- • Content that promotes terrorism or violent extremism, or incites violence or hatred
- • Anything illegal where you or the recipient are, including illegal goods, weapons, drugs, fraud and scams
- • Spam — bulk or unsolicited messages or invitations, including advertising
- • Malware, phishing links, or anything designed to take over a device or account
- • Impersonation of another person or organisation, including through the name you show in chats
You are responsible for everything you send. If someone blocks you, do not try to reach them another way through Nygma.
10.4 Blocking and reporting
Block and delete on any contact removes the chat from your phone and closes it on our servers; the other person is not told. Report a problem in any chat sends us a report from inside the app (you can also write to abuse@genie9.com). Because chats are end-to-end encrypted, we see only what you choose to send us. We acknowledge reports within 48 hours. If someone is in immediate danger, contact your local emergency services first.
10.5 What we do about breaches
We cannot read chats, so we act on reports and on what the law requires of us. If we believe these rules were broken we may, without notice and without refund: suspend or close the accounts involved; refuse further invitations or messages from them; and preserve the information we hold and report it to the authorities — including reporting child sexual abuse material to the National Crime Agency in the UK, NCMEC in the US or the competent authority elsewhere. If you think we got a decision wrong, write to abuse@genie9.com; we will review it at our discretion.
10.6 Keep your chats safe
Your contacts choose the names they show and we do not verify them — use Verify (compare codes in person) before sharing anything sensitive. Disappearing-message timers delete messages on both phones, but the other person can still copy or photograph their screen. We do not guarantee that any message will be delivered.
11. Acceptable Use
11.1 Rules for everyone
You must follow the Acceptable Use Policy. In particular, you must not:
- • Store, share or send illegal content, or content that infringes anyone else's rights
- • Attack, probe, overload, reverse engineer or bypass the security or limits of the Service, except as the law expressly allows
- • Use automated means to access the Service without our written permission
- • Open multiple accounts to get around limits, suspensions or bans
- • Resell the Service or use it to provide a service to others without our written permission
12. Suspension and Termination
12.1 By you
You can delete your account at any time in the app (Settings → Delete account) or at nygma.genie9.com/delete-account. Deletion is permanent and cannot be undone.
12.2 By us
We may suspend or close your account, with or without notice, if you break these Terms or the law, if we are required to by law or a regulator, if your account is used in a way that risks harm to others or to the Service, or if we stop providing Nygma. We may also close free accounts that have been inactive for 12 months after giving 30 days' notice by email. If we stop providing Nygma altogether we will give you at least 30 days' notice so you can download your data.
12.3 What happens next
When an account is closed, its data is deleted and cannot be recovered. No refund is due when we close an account for a breach of these Terms. Sections that by their nature should survive (including 4, 8, 15 to 21) survive termination.
13. Third-Party Services
13.1 Not ours
Nygma relies on third parties such as Apple, Google, Stripe and Amazon Web Services. Their services are governed by their own terms, and we are not responsible for their acts, omissions, outages or decisions, including store billing, refunds and account actions.
14. Our Intellectual Property
14.1 Nygma belongs to us
The Service, the apps, the Nygma name and logo and all related software and content (other than Your Content) belong to Genie9 or its licensors. These Terms give you a limited, personal, non-transferable, revocable right to use the Service; they do not transfer any ownership.
14.2 Feedback
If you send us ideas or feedback, we may use them freely without owing you anything.
15. Disclaimers
15.1 As is
To the fullest extent the law allows, the Service is provided "as is" and "as available". We do not promise that it will be uninterrupted, timely, secure or error-free, that any data will be preserved, or that it will meet your requirements. Nothing in these Terms affects the statutory rights you have as a consumer that cannot be excluded.
16. Limitation of Liability
16.1 What we never exclude
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law, including your statutory rights as a consumer.
16.2 Losses we are not responsible for
Subject to 16.1, we are not liable for:
- • Loss of, or inability to access, data caused by lost or forgotten drive passwords, PINs or recovery phrases, by Time Bomb or Duress mode working as you set them, or by deletions you or anyone using your account made
- • Loss caused by your devices, your email or Google/Apple account being compromised, or by people you shared links or chats with
- • Loss of profits, revenue, business, contracts, goodwill or anticipated savings, and any indirect or consequential loss (the Service is for personal use)
- • Events outside our reasonable control (Section 18)
- • Acts or omissions of Apple, Google, Stripe or other third parties
16.3 Our total liability
Subject to 16.1, our total liability to you for all claims arising out of or in connection with the Service or these Terms is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or £50 if you have not paid us anything.
17. Your Responsibility to Us
17.1 Claims caused by you
To the extent the law allows, you will compensate Genie9 for losses, claims and reasonable costs (including legal fees) arising from Your Content, your breach of these Terms or your breach of the law.
18. Events Outside Our Control
18.1 Force majeure
We are not responsible for any failure or delay caused by events beyond our reasonable control, including outages of hosting, network, app-store or payment providers, cyber-attacks, power failures, strikes, government action, epidemics, war or natural disasters.
19. Changes to These Terms
19.1 Updates
We may change these Terms at any time by publishing a new version on this page. For changes that materially reduce your rights we will also tell you by email or in the app before they take effect. If you keep using the Service after a change takes effect, you accept the new Terms; if you do not agree, stop using the Service and delete your account.
20. General
20.1 The rest
- • We may transfer our rights and obligations under these Terms to another company; you may not transfer yours without our written consent
- • If any part of these Terms is found unenforceable, the rest stays in effect
- • If we do not enforce a right straight away, we can still enforce it later
- • These Terms and the documents they refer to are the whole agreement between you and us about the Service
- • Except for Apple as set out in the End User License Agreement, no one other than you and Genie9 has any right to enforce these Terms
- • We may send notices to the email address on your account or show them in the app
21. Governing Law and Disputes
21.1 Law and courts
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer living in Scotland or Northern Ireland you may also bring proceedings there.
21.2 Bringing a claim
Please contact us first so we can try to resolve the issue. To the extent the law allows, claims must be brought within one year of the event giving rise to them, and only on an individual basis.
